Party for Bosnia and Herzegovina (SBiH) reacted today to the decision of RS National Assembly to call a referendum on the territory of the entity on the support of the law on the Court and the Prosecutor's Office, warning of the legal fact that it is not possible to organize a referendum in one part of the country on issues affecting the operation of state institutions.
In this way, say SBiH, the governing structures of RS continue to undermine the state and its legal institutions and this time they attacked one of the three pillars of state - its judicial system.
Party for BiH reminds that the Court and the Prosecutor Office of Bosnia and Herzegovina are 'legal incidents', but that RS is a “civilization’s incident that was built on the genocide and ethnic cleansing, such that has not occurred since the end of the Second World War and the defeat of fascism in Europe".
Statements made in the debate in RS NA that the BiH Court seeks to change the character of the war in Bosnia and Herzegovina are nothing more than cheap politicizing, because the court prosecutes individuals who committed crimes and the amount of punishment is proportionate to the gravity of the crimes, says the statement.
"When it comes to the character of the war in Bosnia and Herzegovina, the issue was made clear in several judgments of the International Criminal Tribunal for the Former Yugoslavia in The Hague and one example of a valid verdict is the one in Dusko Tadic’s case in 1999", Party for BiH says in the statement.
Also, hiding behind the cases of war crimes they are trying to put aside cases of crime and corruption which are also subjects of investigations of the State Prosecution and among the people under the investigation are those who are the loudest advocates for the abolition of the Court and the Prosecutor’s Office.
When it comes to statements of individual representatives of the international community of being 'gravely concerned' about the recent events, Party for BiH expressed its concern with the fact that the international community is determined not respond to any anti-Dayton activities by RS and with their refusal to use the mechanisms at hand to prevent these activities.
"One gets an impression that the international community and its representatives only declaratively support the rule of law in Bosnia and Herzegovina and protect the Dayton agreement in wording only" said Party for BiH in the statement.
At the end, they expressed hope that this time a more decisive reaction of the international community as the guarantor of the peace agreement will not be left out.
